Abstract

Fundamental rights constitution of cornerstone of a democratic constitutional framework ensuring the protection of individual liberty, equality, and human dignity. These rights are enshrined in the constitution as basic guarantees against arbitrary state action and are essential for the holistic development of individual being justiciable in nature, fundamental rights are enforceable through judicial remedies thereby empowering citizens to seek protection in cases of violation. Although these rights are subject to reasonable restrictions imposed in interest of public order, morality, and national security. This paper examines the concept, nature and significance of fundamental rights, highlighting their role in maintaining the balance between individual freedoms and state authority. it further emphasizes their importance as the foundation of the rule of law and a vital element in preserving the vital element in preserving the A vital element in preventing the democratic ethos of the nation. One of the most important aspect of fundamental rights is that they are enforceable by courts, which means individuals have the power to seek legal protection. Furthermore the paper explores the balance between fundamental rights and reasonable restrictions imposed by the state in the interest of public, order, morality and national security. It also addresses contemporary challenges, including the impact of technological advancement, national securing concerns, and socio- economic inequalities on the effective realization of these rights. The findings of the study reveal that while fundamental rights have significantly contributed to the protection of individual freedoms theire3 practical enforcement continues to face certain limitations. The paper concludes by emphasizing the need for continuous judicial vigilance and legislative reforms to strengthen the protection and accessibility of these rights in a rapidly changing society.
