Abstract

The growth of India’s digital economy presents hitherto unseen opportunities for cybercrimes, requiring an approach to law that not only covers these new challenges but also adapts as new types of crimes emerge. This article considers the current statutory regime, which encompasses the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023, and the Digital Personal Data Protection Act, 2023, analyzing their scope, shortcomings and interaction in dealing with crimes ranging from hacking to phishing to cyber terrorism and breaches of data privacy. Systemic issues such as complex jurisdiction, delayed investigation, and lack of digital literacy skills are highlighted, while solutions offered include the establishment of cyber courts, forensic standards, and citizen-focused digital rights literacy programs.
