Abstract
Intellectual property licensing is an important legal mechanism that allows the owner of intellectual property to authorize another person or business to use their rights while retaining ownership. It promotes innovation, technology transfer, business expansion, and the commercial use of intellectual property. This article explains the meaning and concept of licensing, its legal framework under the Copyright Act, 1957, Trade Marks Act, 1999, Patents Act, 1970, and Designs Act, 2000. It further discusses the different types of licensing, including voluntary and compulsory licenses, and examines international practices relating to intellectual property licensing. The article also analyses significant judicial decisions that have shaped licensing laws in India, highlights the benefits of licensing for businesses and creators, and addresses the legal and practical challenges involved in licensing agreements. It concludes that an effective licensing system promotes economic growth, encourages innovation, and protects the rights of intellectual property owners while ensuring that intellectual property is used lawfully and efficiently.
