Abstract

The rapid expansion of online gaming in India has created significant legal challenges concerning the distinction between legitimate gaming and gambling. With the increasing popularity of online platforms, particularly real-money gaming, the traditional distinction between games of skill and games of chance has become increasingly difficult to apply in the digital environment. This paper examines the legal framework governing online gaming in India, with particular emphasis on the constitutional distribution of legislative powers and the role of State Legislatures in regulating betting and gambling. It further analyses the judicial approach towards determining whether a particular activity predominantly involves skill or chance, with reference to significant judicial decisions. The paper also explores how the emergence of online real-money gaming has complicated this traditional classification, particularly where monetary stakes are involved. The recent decision in Directorate General of GST Intelligence v. Gameskraft Technologies Pvt. Ltd. is examined to understand the changing legal approach towards online gaming and the treatment of monetary stakes under the GST framework. The study concludes that the legal character of an online gaming activity cannot always be determined merely by identifying the underlying game; the manner in which the activity is conducted, particularly the involvement of monetary stakes and uncertain outcomes, has become increasingly significant.
