Are India's Existing Law adequate to Regulate Harmful Deepfakes

This paper examines the adequacy of India’s existing legal framework in addressing harmful deepfakes. It analyses provisions under the Information Technology Act, 2000, Bharatiya Nyaya Sanhita, 2023 and constitutional privacy protections that may be applied to deepfake-related offences. The paper argues that while existing laws can address several forms of harmful deepfakes, they were not specifically designed for AI-generated content. It emphasises the need for clearer regulation, platform responsibility and digital awareness.
