Marital Rape Exception in India Constitutional Debate and Criminal Law Reform

The marital rape exception in India remains one of the most contested issues in contemporary constitutional and criminal law, reflecting the tension between colonial legal traditions and modern constitutional values. Rooted in the doctrine of irrevocable marital consent, the exception continues to deny married women the same legal protection against sexual violence available to unmarried women. This paper examines the constitutional validity of the marital rape exception through the lens of Articles 14 and 21 of the Constitution, focusing on the principles of equality, dignity, privacy, and bodily autonomy. The paper also addresses concerns regarding the potential misuse of criminal law and evidentiary challenges, arguing that such concerns should not outweigh the constitutional rights of survivors. It concludes that meaningful reform must extend beyond criminalisation to include procedural safeguards, legal awareness, and a consent-based understanding of marriage. Ultimately, the study contends that abolishing the marital rape exception is essential to aligning Indian criminal law with constitutional guarantees of equality, autonomy, and human dignity.
