Abstract

It examines the tension between state security powers and constitutional liberties under Articles 14, 19, and 21, focusing on surveillance and phone-tapping law, the PUCL v. Union of India case as a foundational precedent, and the need for a proportionality standard to test the reasonableness of state intrusion.
