Abstract

Across Asia, businesses are quietly deserting the courtroom. Cross-border commercial actors, wearied by cost and delay, increasingly prefer a negotiated exit to a litigated one. Three jurisdictions illustrate divergent responses to that appetite. Singapore and Hong Kong have long marketed themselves as neutral, institutionally mature venues. India, historically a laggard, has now legislated. The question is whether legislation alone closes the gap.
