Custodial Violence in India

Custodial violence is the term given to inhuman treatment of individuals in judicial and police custody. Custodial violence refers to the physical, psychological, or sexual abuse imposed on individuals while they are in police. It is a violation of human rights and a serious breach of constitution and legal safeguards guaranteed in democratic societies. This paper also explores the twofold strategy for combating custodial violence: the legal remedies available under Indian law and the broader human rights framework both domestically and internationally. It discusses the role of the judiciary evolving principles of custodial justice. This paper also explores the historical context of custodial violence in India, and discusses the role of NHRC. Moreover, this paper will examine why India has failed to ratify the United Nations Convention Against Torture (UNCAT) and what impact it has on the enforcement of human rights.
