Human Rights Violations in India: Legal Remedies

Human rights are fundamental to preserving human dignity, equality and justice in a democratic society. Despite India’s comprehensive constitutional and statutory framework, including Fundamental Rights, Directive Principles and the Protection of Human Rights Act, 1993, violations such as custodial violence, discrimination, gender-based violence, child exploitation, bonded labour and environmental injustice continue to persist. This research examines the nature and causes of human rights violations in India and evaluates available constitutional and statutory remedies. It analyses judicial interventions, landmark Supreme Court judgments, the role of the National Human Rights Commission and India’s international obligations. The paper concludes that effective implementation, institutional accountability, legal awareness and policy reforms are essential for meaningful human rights protection.
