Abstract

Deepfakes have emerged as a significant digital threat with the rapid development of Artificial Intelligence and advanced digital technologies. By manipulating or generating realistic images, videos, and audio, deepfakes can imitate individuals with remarkable accuracy, making it increasingly difficult to distinguish authentic content from fabricated material. While deepfake technology has legitimate applications in entertainment, education, accessibility, and creative industries, its misuse has raised serious concerns relating to privacy, defamation, identity theft, misinformation, cybercrime, and electoral integrity. India has witnessed several deepfake incidents involving celebrities, politicians, journalists, and ordinary individuals, highlighting the urgent need for effective legal safeguards. This paper examines the existing Indian legal framework dealing with deepfakes, including provisions relating to cyber offences, privacy, defamation, and intermediary liability. It further analyses the limitations and challenges of the present framework and explores whether existing laws are sufficient to address rapidly evolving AI-generated threats. The paper concludes by suggesting the need for stronger regulation, technological detection mechanisms, and greater public awareness to ensure responsible use of Artificial Intelligence.
