Digital Evidence in Courts: Admissibility, Authentication and Challenges in the Digital Age

The debate over uniform marriage laws in India reflects the complex relationship between equality, individual rights, and religious diversity. India currently follows a pluralistic system of personal laws under which different religious communities are governed by separate legal provisions relating to marriage, divorce, maintenance, and other matrimonial matters. While this framework recognizes cultural and religious autonomy, differences among personal laws have raised concerns regarding gender discrimination, unequal rights, and inconsistency in legal protection. This article examines whether a uniform legal framework governing marriage can promote equality and gender justice while remaining sensitive to India’s diverse social and religious traditions. It explores the constitutional basis of uniformity, particularly Article 44, alongside the fundamental rights to equality and religious freedom. The article also considers the arguments supporting uniform marriage laws, including national integration and equal protection, as well as concerns regarding cultural identity and religious autonomy. It concludes by examining the need for a balanced approach that promotes constitutional equality without unnecessarily undermining India’s pluralistic character.
