Abstract

In Hermès International & Anr. v. Macky Lifestyle Private Limited & Anr. (2025), the Delhi High Court granted a permanent injunction against an Indian MSME for marketing lookalike bags on IndiaMART, officially declaring the 3D shape and silhouette of the iconic "Birkin" bag as a "Well-Known Trademark" under the Trade Marks Act, 1999. Rejecting the defendant's plea of zero sales, Hon’ble Mr. Justice Tejas Karia established two landmark principles: first, a non-traditional 3D trade dress can independently receive maximum statutory anti-dilution protection if it serves as a primary source identifier; and second, under the Doctrine of Trans-Border Reputation, a global luxury brand requires no physical presence or domestic sales in India to secure nationwide protection, as spillover goodwill from digital and international media exposure is legally sufficient. Consequently, the Court affirmed that unauthorized digital renderings constitute actionable "use in the course of trade," effectively expanding trademark infringement and passing-off liability into virtual marketplaces.
