Abstract

This paper explores Indian cyber law's development since the passage of the Information Technology Act, 2000, and its current strains, arguing that lack of law is the prime hurdle. India has a new criminal law, a complete set of intermediary regulations, a data protection act, and a rising number of relevant constitutional verdicts. The prime problem is the amount and coherence of what's been built: too much relies on delegated legislation, there are few safeguards in cases that the State itself acts, and enforcement trails far behind the amount of online harm. Cybercrime and electronic evidence, intermediary liability and online speech, data protection, artificial intelligence and synthetic media, and surveillance and shutdowns are the five areas of stress analyzed in this paper that concludes with recommendations. As of October 2026, developments are reported.
