Abstract

This commentary reads together two Supreme Court decisions under the SARFAESI Act, 2002: Celir LLP v. Bafna Motors (2023) and M. Rajendran v. KPK Oils and Proteins India Pvt. Ltd. (2025). It explains that a borrower's right of redemption ends when the notice of sale is published under amended Section 13(8), that one composite notice of sale satisfies Rules 8(6) and 9(1), and that this applies irrespective of when the loan was taken. It lists takeaways for secured creditors, borrowers and auction purchasers, and notes the Court's call to revisit Section 13(8).
