Abstract

Inverted Justice: How the PMLA and UAPA have turned bail into a rule of imprisonment . A fundamental principle of Anglo-Saxon criminal law—widely adopted in Indian constitutional law by Justice V.R. Krishna Iyer—states that "bail is the rule and jail is the exception". This principle, stemming from the presumption of innocence guaranteed by Article 21 of the Indian Constitution, requires that a person's personal liberty should not be restricted before being convicted unless it is absolutely necessary to ensure the accused appears in court or to protect the integrity of the judicial process . However, specific laws such as Section 45 of the Prevention of Money Laundering Act, 2002 (PMLA), and Section 43D (5) of the Unlawful Activities (Prevention) Act, 1967 (UAPA), have systematically reversed this principle . By setting up strict legal conditions and limiting the courts' discretion, these provisions place the burden of proof on the accused at an early stage, making it practically impossible to obtain pre-trial release. This in-depth legal analysis examines the workings of these statutes, the constitutional conflicts they trigger, and the key judicial decisions concerning bail under the PMLA and UAPA . It outlines the historical shift from a liberal, liberty-based approach to a strict system of preventive legislation. It argues that in practice, the operation of these laws turns pre-trial detention into a form of summary, unjudged punishment. Finally, the article suggests concrete reforms to restore procedural fairness while taking into account both the state's security interests and the constitutional rights of individuals.
