Abstract

Partnership remains one of the most flexible forms of business organization in India. It enables persons to combine their resources, skills and experience and carry on business with an intention to share profits. The principal legislation governing partnership firms is the Indian Partnership Act, 1932. The Act regulates the formation of partnership, rights and duties of partners, mutual agency, liability, registration, admission and retirement of partners, and dissolution. This article examines the major principles of partnership law with reference to important decisions of the Supreme Court of India. Particular attention is given to the legal status of a partnership firm, partnership property, mutual agency, minors, registration and dissolution. The article further examines the contemporary relevance of the Act, its limitations in the modern commercial environment and the need for improved contractual and legal practices.
