Abstract

The enactment of the Protection of Children from Sexual Offences (POCSO) Act in 2012 represented a major shift in India’s penal law, moving away from generic criminal provisions toward a specialized, child-centric legislative framework. Designed to comply with global human rights standards set by the United Nations Convention on the Rights of the Child (UNCRC), the statute criminalizes child sexual abuse while mandating sensitive procedural mechanisms to protect young victims from legal retraumatization. This article analyzes the legal architecture of the POCSO Act, examines critical constitutional friction points—including the criminalization of adolescent romantic relationships, tensions between mandatory reporting and medical confidentiality, and the reverse burden of proof—and incorporates pivotal Supreme Court judgments that define its modern statutory application. Finally, it outlines comprehensive structural reforms to improve trial efficacy while preserving due process.
