Abstract

This case commentary examines the landmark decision of the Delhi High Court in Amar Nath Sehgal v. Union of India, which significantly strengthened the protection of moral rights of artists under Indian copyright law. The judgment interpreted Section 57 of the Copyright Act, 1957 in a manner that recognizes artistic works as extensions of the creator’s identity and reputation, rather than mere objects of ownership. By holding the State accountable for the destruction and negligent treatment of a commissioned artwork, the Court affirmed that moral rights survive the transfer of ownership and impose a duty of care on custodians of artistic creations. This case marks an important incremental step in safeguarding artistic integrity and creative dignity in India.
