Abstract

This case commentary analyzes the Supreme Court of India’s ruling in Delhi Pollution Control Committee v. Lodhi Property Company Ltd. (2025). Overturning the restrictive precedent set in Splendor Landbase Ltd., the Court held that Pollution Control Boards possess administrative authority under Section 33-A of the Water Act and Section 31-A of the Air Act to mandate environmental compensation and advance bank guarantees without undergoing a criminal trial. The decision establishes a clear distinction between punitive criminal sanctions (requiring court trials) and administrative civil restitution intended to repair or prevent environmental damage. Furthermore, the Court evolved the "Polluter Pays" principle into a proactive, ex-ante preventive instrument that secures financial liability for potential risks before harm occurs. To protect against administrative arbitrariness under Articles 14 and 21 of the Constitution, the Court conditioned this expanded regulatory power on the formulation of transparent statutory rules adhering to principles of natural justice. Finally, the commentary highlights lingering practical challenges, including interim reliance on non-statutory guidelines and procedural asymmetries between the Air and Water Acts.
