Abstract

This article explores how artificial intelligence and cyber warfare fit within existing rules of international law, especially international humanitarian law. Although these legal principles are meant to apply to all forms of conflict, their use becomes more complicated when dealing with modern technologies. The paper focuses on key principles such as distinction, proportionality, and precaution, and considers whether they can still function effectively when decisions are made by automated systems and when the impact of operations is not always visible or physical. It also looks at the issue of accountability, particularly the difficulty of identifying who should be held responsible when actions involve AI systems or complex cyber operations. The analysis shows that while current legal rules do apply in theory, applying them in practice is often uncertain and inconsistent. The article argues that the real challenge is not the absence of law, but the gap between existing legal principles and their ability to deal with rapidly evolving technologies in modern conflict situations.
