Abstract

Corporate fraud in India poses serious threats to financial stability, investor confidence, and market integrity. It includes deceptive practices like financial misstatements, embezzlement, insider trading, and bribery. Major scandals from Harshad Mehta to Nirav Modi have exposed systemic lapses in oversight. India’s legal framework, anchored in the Companies Act, Bharatiya Nyaya Sanhita (2023), and other financial laws, provides for criminal prosecution, asset confiscation, civil remedies, and whistleblower protections. Regulatory bodies like SFIO, SEBI, and ED play key enforcement roles. However, effective deterrence depends on timely enforcement, inter-agency coordination, and a culture of accountability and compliance.
