Abstract

The principle of strict liability forms the cornerstone of the global anti-doping regime, holding athletes responsible for the presence of prohibited substances in their bodies regardless of intent, negligence, or fault. While this doctrine plays a crucial role in preserving the integrity of sport, ensuring fair competition, and promoting uniform enforcement under the World Anti-Doping Code (WADC), it has also generated significant legal and ethical debate. This paper examines the rationale behind strict liability in anti-doping law and evaluates whether the current regulatory framework appropriately balances sporting integrity with athletes' rights. Through an analysis of the World Anti-Doping Code and landmark cases involving Maria Sharapova, Shawne Merritt, and Jannik Sinner, the study highlights the practical challenges posed by inadvertent doping, contaminated supplements, and reliance on medical professionals. It argues that although strict liability remains essential for effective anti-doping enforcement, its application must be accompanied by proportionate sanctions and procedural safeguards that distinguish intentional cheating from genuine mistakes. The paper concludes by proposing reforms, including a graduated liability framework, greater accountability for athlete support personnel, enhanced scientific evidence, and improved preventive measures through digital verification systems. Such reforms would strengthen both the credibility and fairness of the anti-doping regime while preserving the fundamental objective of protecting clean sport.
