Abstract

This commentary examines the Indian Supreme Court’s decision in Amazon.com NV Investment Holdings LLC v. Future Retail Ltd. and its significance for emergency arbitration in India. It argues that the judgment marked a major shift in Indian arbitration law by recognizing emergency arbitrator orders as enforceable under Section 17 of the Arbitration and Conciliation Act, 1996. The commentary analyses how the Court adopted a functional interpretation of “arbitral tribunal” and “arbitral proceedings” to preserve party autonomy and support institutional arbitration. It also evaluates the judgment’s limits, including concerns over ex parte relief, unresolved enforcement questions, and the need for clearer statutory codification. Set against a global backdrop, the article shows that while the decision strengthened India’s arbitration-friendly image, it also exposed the risks of relying too heavily on judicial interpretation in a commercially important area of law.
