Abstract

The cross-section of law and technology is emerging with numerous shifts in the digital environment. Whereas the commission of offences is also rising at an alarming rate, where offenders use technology as a whole or part in any stage of the crime. The primary objective of cyber forensics is to aid the court in its evidentiary work through accumulating knowledge and establishing facts that serve as the legal basis for justice. This paper will highlight the methodologies of collection and preservation of electronic records in light of both old and new Indian evidence law along with technology law. The structured scientific and legal framework leads to the effective administration of the criminal justice system in a country like India. Hence, this paper will delve into the realm of critical analysis of cyber forensics as a legal and technical medium to examine the evidentiary dimensions in order to secure a just and fair trial.
