Abstract

The unprecedented heightening of social media has reshaped the nature of freedom of speech and expression, making it possible for people to communicate, acquire information, and take part in public discussions like never before. The article aims to look into the constitutional and legal aspects of freedom of speech in the current internet era, especially in relation to Article 19(1)(a) and reasonable limitations as prescribed by Article 19(2) of the Constitution of India. It reviews the various prospects offered by social media in terms of taking part in democracy, acting for certain causes, and spreading messages, along with tackling some of the modern-day challenges such as misinformation, hate speech, cyberbullying, online censorship, and state monitoring. The paper also provides a legal overview of online speech rights in India, focusing on the Information Technology Act of the year 2000 and the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, various court cases such as Shreya Singhal v. Union of India, Anuradha Bhasin v. Union of India, Secretary of Information and Broadcasting Ministry v. Cricket Association of Bengal, etc. Finally, it draws the conclusion that protecting the freedom of speech in the internet era requires a balanced position.
