Abstract

For decades, if you wanted your commercial dispute arbitrated fast and fairly, you looked to Singapore, London, or Hong Kong, anywhere but India. Indian courts had a reputation for meddling in arbitral awards, and nobody wants a "final" decision that gets relitigated for years. But something has been shifting. This piece traces India's real, if uneven, transformation into a serious arbitration contender. The Supreme Court has done the heavy lifting: reining in judicial interference, letting Indian companies arbitrate abroad, adopting the "Group of Companies" doctrine to bind non-signatories, and most recently, sharply limiting how much courts can second-guess an arbitral award. New institutions are popping up beyond the usual Delhi-Mumbai axis, and GIFT City is positioning itself as India's answer to Dubai's DIFC. But ambition isn't infrastructure. GIFT City still lacks the international judges, foreign-lawyer access, and institutional independence that make rivals like the DIFC genuinely attractive rather than merely available. And enforcement the part that actually matters to a party that's already won, remains painfully slow, bogged down by years of post-award objections. A hub isn't measured by its best decision; it's measured by its median timeline, and India still has ground to cover there. The verdict? India doesn't need another committee report telling it what a global arbitration hub looks like. It needs the discipline to actually finish building one.
