Abstract

The debate between activism and judicial restraint concerns the extent to which courts should exercise their powers while interpreting the Constitution and reviewing legislative and executive actions. Judicial activism allows courts to intervene when fundamental rights are threatened or when constitutional obligations are ignored while judicial restraint stresses respect for authority established precedents and the separation of powers. This paper looks at the development of both approaches with a focus on the Indian constitutional framework and the role of judicial review in maintaining a balance among the three organs of government. It discusses judicial decisions, such as Kesavananda Bharati v. State of Kerala Hussainara Khatoon v. State of Bihar, Vishaka v. State of Rajasthan and A.D.M. Jabalpur v. Shivakant Shukla to see how judicial intervention has shaped the protection of fundamental rights and constitutional governance. The paper also examines concerns about overreach especially when courts step into areas traditionally handled by the legislature or the executive. It argues that neither judicial activism nor judicial restraint can be seen as always better. Much restraint may leave people without effective remedies against unconstitutional actions while too much intervention may weaken the separation of powers. The right judicial approach therefore depends on the questions, at hand the rights involved and the limits of judicial authority. Ultimately the paper emphasizes the importance of keeping a balance between protecting values and respecting the democratic duties of the other branches of government.
