Abstract

Death may end biological life, but it does not always end legal existence. This blog explores the concept of the legal life of the dead, examining how law continues to recognize the deceased through succession, reputation, intellectual property, digital assets, and emerging challenges such as AI-generated "ghosts" and posthumous reproduction. It also highlights the gaps in India's legal framework, particularly concerning posthumous dignity and the absence of comprehensive laws addressing issues like necrophilia and AI-based identity replication. Ultimately, the blog argues that while law preserves a person's legacy after death, it must evolve to protect that legacy in an increasingly digital world.
