Abstract

This case commentary critically examines Meta Platforms Inc. & WhatsApp LLC v. Union of India (2026), a landmark Supreme Court decision striking down Rule 4(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which required significant social media intermediaries to enable identification of the “first originator” of encrypted messages. The judgment is analysed through the constitutional lenses of privacy, freedom of speech, and the doctrine of proportionality. While endorsing the majority's conclusion that mandatory traceability disproportionately infringes Articles 19(1)(a) and 21 of the Constitution, this commentary argues that the Court missed a crucial opportunity to formulate an interim constitutional framework governing digital surveillance. Drawing upon comparative jurisprudence, international human rights standards, and existing Indian precedent, it highlights the regulatory vacuum left by the decision and advocates comprehensive legislative reforms to reconcile legitimate national security interests with the constitutional protection of encrypted communications and informational privacy in India's evolving digital ecosystem.
