Abstract

The technology of Generative AI is now capable not only of writing, painting, and composing, but even transforming the work of others. While India’s Copyright Act, 1957 was framed taking humans into consideration as the creators, yet there is an exception for Computer Generated Works and an additional set of Moral Rights provided for in Section 57. The present article enquires into the possibility of using these provisions to safeguard the human creators in case AI transforms or creates a work. It contemplates that while the Copyright Act provides for a sufficient framework for the purpose, it lacks provisions regarding the role of humans in the creation, alteration by AI, misattribution, and proving the same. Keywords: Artificial Intelligence, Authorship, Moral Rights, Section 57, Copyright Act, 1957, Generative AI, Right of Integrity, Right of Attribution.
