Abstract

This paper explores the complex legal safeguards available to tenants in Ireland's local authority housing, focusing on the core Housing Act 1966 and subsequent revisions. It examines key aspects such as tenure security, income-based rent determination through differential systems, maintenance responsibilities, succession entitlements, and dispute resolution options. Combining legislative review, key court rulings, and recent policy developments, the analysis highlights how social housing leases differ from private rentals governed by the Residential Tenancies Act 2004. The article deals with ongoing challenges like inconsistent enforcement and the impacts of persistent housing shortages, calling for better integration with human rights standards. Aimed at law students and novice researchers, it aims to highlight potential reforms to strengthen Ireland's social housing framework, promoting greater equity and stability amid evolving societal needs.
