Abstract

Introduction: In the realm of business, a trademark is an essential instrument for differentiating one company’s products or services from another. It consists of various elements such as words, logos, and slogans . Trademarks are recognized as a form of Intellectual Property and are protected by the Trade Marks Act, with a two-fold objective: to prevent consumer confusion and deception by business entities . The essence of trademark law lies in the exclusive right of owners to use their marks . The Supreme Court of India has stated that trademark legislation aims to clarify the source of goods, establishing a coherent link between products and their origins . Infringement occurs when unauthorized parties use similar marks. Proving likelihood of confusion, rather than actual confusion or damage, suffices for legal claims, as outlined in Halsbury’s Laws of England .
