Abstract

India's journey towards LGBTQ+ rights reflects a significant shift from colonial-era repression to a more inclusive legal framework. Once criminalized under Section 377 of the Indian Penal Code, consensual same-sex relationships were decriminalized by the Supreme Court in the landmark Navtej Singh Johar judgment (2018). The courts have since affirmed LGBTQ+ individuals' constitutional rights to equality, dignity, privacy, and freedom. Transgender rights have also advanced through the NALSA judgment and the Transgender Persons Act, 2019. However, civil rights like marriage and adoption remain unrecognized. Continued awareness and legal reforms are essential for true equality.
