Abstract

Article 370 of the Indian Constitution delineates the authority of Jammu and Kashmir to legislate for its residents. The provisions applicable to other states in India do not extend to Jammu and Kashmir. This report will succinctly examine the revocation of Article 370, including the rationale behind its initial implementation and its intended purpose, as it was originally conceived as a temporary measure. The report will also address the challenges encountered by both the central government and the people of Kashmir. It will provide an overview of the process of revocation and the subsequent consequences, including the enforcement of Section 144 . Additionally, it will present the Supreme Court's ruling regarding the revocation of Article 370 and discuss whether the presidential orders adhered to legal protocols. The analysis will encompass both the advantages and disadvantages, as well as the potential benefits and growth anticipated for the state. The conclusion will assess the constitutional validity of the decision to revoke the article and whether it can be deemed undemocratic.
