Abstract

Protecting industrial designs is very crucial because it boosts the creativity, innovation and business growth in today's industries. To give legal protection to the new and original designs, and also replace the old Designs Act of 1911, the Designs Act of 2000 was passed. This law aims to protect the feel and look of products and stop other people from copying them without the permission. By giving exclusive rights to owners of registered designs, the act promotes fair competition in market. This helps to encourage the people to create new and interesting designs, which can lead to business growth. The act is an important tool for companies and individuals who want to protect their unique designs and stay ahead in market. The designs act of 2000 has become significant due to rapid growth of globalization and industrialization. Modern business depends on product appearance and consumer attraction. Product shape, attractive packaging, ornamentation and configuration influence the customer’s choice. Design protection has become important for industries which includes electronics, fashion, furniture, automobiles, consumer goods and packaging. This paper examines the role of designs act 2000 in protecting the designs in India. It discusses the historical growth of the designs law, the key provisions of Act, landmark judgements, and comparative analysis with foreign jurisdictions. The paper highlights challenges faced by the act in India.
