The swift and resounding proliferation of blockchain technology has opened the doors to a renaissance of legal innovation, especially when it concerns dispute resolution. This chapter explores how smart contracts and decentralized justice systems may revolutionize dispute management and resolution in the digital-first world. Smart contracts allow for automation, transparency, and trustless enforceability, thereby going against conventional contract law and dispute resolution. The evolution of decentralized justice brings forth new mechanisms for the settlement of disputes through distributed pools of jurors, the incentivization of participation, and transparent decision-making.
Initially, the chapter unfolds the legal and technical premises of smart contracts while setting them apart from the traditional contractual frameworks and analysing their recognition status within various jurisdictions. Furthermore, it looks into the origin and development of decentralized justice, going back to online disputes and online skeleton models, while orchestrating the actors that influence this landscape.
