Abstract

The Transgender Persons (Protection of Rights) Amendment Act, 2026 marks a significant shift in India's legal framework governing gender identity by replacing the principle of self-identification with a system of medical verification. This article critically examines the constitutional and legal implications of the Amendment, arguing that it departs from the rights-based framework established by the Supreme Court in National Legal Services Authority v. Union of India (NALSA) and reinforced through subsequent decisions on privacy, dignity, and equality. It analyses how the Amendment narrows the statutory definition of transgender persons, retrospectively withdraws previously recognised legal identities, conflates intersex variations with gender identity, and introduces broadly worded criminal provisions that may adversely affect legitimate gender-affirming care and community support. The article further evaluates these changes in light of Articles 14, 19, and 21 of the Constitution, the principles governing retrospective legislation, and the State's constitutional obligation to protect the autonomy and dignity of transgender persons. It concludes that the Amendment represents a departure from India's evolving constitutional jurisprudence on gender identity and argues that any future legal framework must restore self-identification, preserve substantive rights, and faithfully implement the constitutional vision articulated in NALSA.
