Abstract

The integration of modern global commerce and electronic communication has fundamentally altered the mechanisms of contract formation. Traditionally, principles of contract centred around physical documents, formal signatures and localised seals, tested by the speed of instantaneous digital interactions. The landmark judgement of Trimex International FZE v. Vedanta Aluminium Ltd, 2010, is a key precedent to this evolution. Evaluating the legal validity of electronic mail transactions and the enforceability of unsigned arbitration clauses, the Apex Court established that a binding commercial contract can arise through sequential email correspondence containing absolute and unconditional acceptance.
