Abstract

MMTC Ltd. v. Sterlite Industries (India) Ltd. (1996) represents a pivotal moment in Indian arbitration jurisprudence, addressing the enforceability of agreements framed under the 1940 Arbitration Act in light of the newly enacted Arbitration and Conciliation Act, 1996. The controversy centred on whether an arbitration clause stipulating an even number of arbitrators was invalid under Section 10 of the 1996 Act. Rejecting MMTC’s challenge, the Supreme Court held that Section 10 was a procedural safeguard rather than a substantive requirement, and that the validity of an arbitration agreement must be tested solely against Section 7. By affirming party autonomy and ensuring continuity between the old and new regimes, the Court minimized judicial interference and reinforced arbitration as an effective dispute resolution mechanism. The decision continues to influence later jurisprudence, shaping India’s transition towards a modern, pro-arbitration legal framework.
