Abstract

The Real Estate (Regulation and Development) Act, 2016[ Real Estate (Regulation and Development) Act, 2016] (RERA) represents a major legislative intervention in India’s real estate sector to enhance transparency, accountability and consumer protection. At present the real estate sector has long followed a tradition of delays in project completion, consumer recourse, disclosures, regulatory capture, and uneven bargaining power between the buyer and seller. Thus the enactment of legislation such as RERA has been imperative in transforming the real estate sector to create a fairer marketplace. In this article, we make sense of the development, objectives, key provisions, and recent impacts of RERA in engendering a fair and efficient real estate marketplace. We also consider the implementation challenges RERA has dealt with and the way forward for future iterations of ongoing regulatory reform.
