Abstract

The Telecommunications Act, 2023 marks a monumental shift in India’s digital governance framework, replacing archaic colonial statutes—such as the Indian Telegraph Act, 1885—with a modernized legal architecture. Key statutory reforms include establishing spectrum auctioning as the default route for commercial allocation while enabling administrative allocation for satellite communications and national security. Section 11 strengthens Right of Way provisions to accelerate 5G deployment, while the legacy licensing regime is streamlined into an authorization model alongside the creation of the Digital Bharat Nidhi. However, the legislation faces criticism over potential executive overreach and surveillance risks. Section 20 grants broad powers for message interception and service suspensions without explicit judicial oversight or direct alignment with Puttaswamy privacy standards. Ambiguity surrounding Over-The-Top (OTT) platforms and the dilution of TRAI’s advisory mandate further raise regulatory concerns. Ultimately, the Act’s success hinges on subordinate rules that balance state security with civil liberties and market competition.
