Abstract

To ensure fairness and justice for all citizens, the Uniform Civil Code (UCC), as outlined in Article 44 of the Indian Constitution, aims to standardize personal laws across various religions. Although the UCC is based on the principles of secularism and gender justice, its implementation is a highly debated topic in Indian legal and political discussions. This paper looks at the UCC's legal foundations, historical background, and current debates. It explores the tension between legal uniformity and religious freedom, highlighting both the potential benefits of national unity and the concerns of minority communities about cultural loss. By examining legal texts, important case law, and comparative examples, the study supports a consultative and inclusive approach to reforming personal laws—one that respects secular values and India’s diverse society. The paper wraps up by offering practical suggestions for developing a unified civil code that respects the fundamental rights of all communities.
