Abstract

A trademark is a distinctive sign that identifies and differentiates the goods or services of one enterprise from those of others, functioning as a crucial tool for brand recognition, consumer trust, and commercial goodwill. This paper examines the concept, legal framework, and registration process of trademarks in India under the Trade Marks Act, 1999, along with its alignment with international agreements such as TRIPS and the Madrid Protocol. It highlights the essential characteristics and types of trademarks, emphasizing their role in ensuring quality assurance, market distinction, and legal protection. The paper further explains the step-by-step procedure for trademark registration, including search, application, examination, publication, opposition, and renewal. In addition, the study critically analyses the growing challenges of trademark infringement in the digital marketplace. With the rise of e-commerce, social media, and online platforms, new forms of infringement such as cybersquatting, keyword advertising misuse, counterfeit sales, and social media impersonation have emerged. The paper discusses key judicial decisions that have extended trademark protection to digital environments and examines available civil, criminal, and administrative remedies. It also addresses enforcement challenges such as cross-border disputes, anonymity of infringers, and technological complexities. The paper concludes that while the existing legal framework provides robust protection, continuous evolution and proactive enforcement strategies are essential to effectively safeguard trademarks in the rapidly changing digital economy.
