Abstract
In our day to day life, we often come across with different brands- whether it’s grabbing a coffee from Starbucks, wearing a watch from Titan or, scrolling through Instagram. These brands are not just about random names, they’re legally protected trademark that gives immense value and global recognition to brands. As per the report presented by the Times of India, globally India is at 3rd stage at trademark filing- 540,000 filed in 2024.
Trademarks are more than just names or symbols, they protect the reputation, trust, and quality attached to brands goods and services which safeguards confusion in the minds of consumers. An increase in trademark filings in India is a sign of increasing awareness amongst entrepreneurs and business houses regarding brand identity in a competitive economy.
Yet with this expansion comes the need to safeguard trademarks against misuse, infringement, and counterfeiting. It is trademark law that ensures such rights are protected by allowing only the registered owners to use and reap the benefits from their brand identity. It not only assists consumers in making informed decisions but also facilitates fair competition in the market.
Every country protects trademark through its own legal framework. The way the trademark rules govern in the U.S may not be the same as in India. Safeguarding a brand identity is almost universal in the present era businesses, entity and owners are getting more oriented towards their trademark registration, the journey of getting that protection looks different from one country to another.
