Abstract

This blog, titled “Two Courts, One Question: Is Menstrual Leave a Risk or a Right?”, examines the contrasting approaches of the Karnataka High Court and the Supreme Court on menstrual leave in India. It focuses on the constitutional principles of equality, dignity, and humane working conditions, while analysing menstrual leave as both a potential workplace right and a policy concern. The blog compares both judgments, evaluates their benefits and limitations, and concludes by considering menstrual leave as a measure of dignity and substantive equality.
