Abstract

Divorce is an important aspect of family law in India that provides a legal tool for ending a marriage when the relationship between husband and wife can no longer continue. In India, divorce is governed by different personal laws like the Hindu personal law and Muslim personal law and other statutory provisions, making the legal framework quiet complex and diverse. The Hindu Marriage Act, 1955, the Special Marriage Act, 1954, Protection of Rights on Marriage Act, 2019, and other personal laws provides grounds of divorce and procedures for dissolution of marriage. This article examines the main grounds of divorce, including cruelty, desertion, adultery, and mutual consent, along with the legal remedies rendered to the spouses. It also explains the role of the judiciary in protecting individual dignity, personal liberty, and the welfare of children during matrimonial disputes. A considerable amount of attention is given on the challenges of time-consuming litigation, financial insecurity, gender inequality, and the need for a more efficient divorce process. The article argues that divorce laws should balance the sanctitude of marriage along with the individual’s right to live with dignity and freedom. It concludes that legal reforms, accessible family courts, and other effective support systems are necessary to ensure for a fair and just approach to matrimonial dissolution in India.
