Abstract

This paper looks into the constitutional challenges raised against Section 8 of the Whistle Blowers Protection (Amendment) Bill, 2015 that bans assistance in preparing or filing whistle blower complaints. It says that the law sets out a formal process for reporting corruption, but in practice this is out of reach of ordinary people. The paper concludes that without procedural support, whistleblower rights would not be meaningful rights, but paper rights.
