Abstract

In an era marked by rapid digital expansion and increasing ease of content replication, the protection of creative works has become a pressing concern for artists and creators in India. This article examines the role of Intellectual Property Rights (IPR) as a crucial legal framework safeguarding artistic and creative expression. It outlines the classification of intellectual property in India and analyses the statutory protection offered under key legislations such as the Copyright Act, 1957, the Patents Act, 1970, the Trade Marks Act, 1999, the Designs Act, 2000, and the Geographical Indications of Goods Act, 1999. The article further highlights practical mechanisms available to artists for protecting and enforcing their rights, emphasizing the importance of documentation, registration, and judicial remedies. By bridging legal principles with practical enforcement strategies, the article seeks to enhance awareness among artists and creators about asserting ownership, preventing misuse, and navigating intellectual property protection in India.
