Abstract

Few decisions have exerted a gravitational pull on the law of contract quite like ‘Carlill v. Carbolic Smoke Ball Co’ . Decided by the English Court of Appeal in 1893, the case dismantled a series of doctrinal objections that Victorian counsel raised against enforcing a newspaper advertisement as a binding promise. It confirmed that a unilateral offer to the world may crystallise into contract the moment its terms are performed, that performance itself constitutes acceptance, and that the deposit of £1,000 with the Alliance Bank furnished the intention to be bound. This commentary revisits the decision not as a museum piece but as a living blueprint, tracing how Lindley, Bowen and A.L. Smith LJJ engineered principles that continue to underpin digital rewards, consumer promotions in 2026.
